White Label Services

This Agreement is made between Forty Miles West (“The Service Provider”), located at Unit 2 Bollinside, Macclesfield, SK11 7RN, UK, and the Client (“The Agency”), located at their principal place of business.

By accepting any quote, proposal, or using our services, the Agency agrees to be bound by the terms outlined in this Agreement. If the Agency does not agree to these terms, they should not use our services.

1. Contactable Hours & Availability

  • The Service Provider is contactable between 9:00am – 6:00pm, Monday to Friday.
  • Unless otherwise agreed, the Service Provider is available for project work on set days.

2. Technology Stack & Licensing

  • Development stack: Bricks Builder, ACF Pro, and either Automatic.CSS (ACSS) or Core Framework.
  • Additional plugins may be required depending on the project.
  • The Agency must supply all plugin/theme licences upon project handover.

3. Timelines & Project Scope

  • Clear project timelines must be provided, including preview and go-live dates.
  • The Service Provider may decline projects if schedules are not compatible.
  • Unless otherwise agreed, deployment, server/site security, and SEO are omitted.

4. Services Not Offered

  • No HTML email templates.
  • No legacy websites or outdated builders/themes.
  • No deployment, server/security/SEO/email/hosting unless agreed.

5. Payment Terms

  • 50% due upfront, 50% due upon development completion.
  • Larger projects may be billed in milestones.
  • Day rate: £350. Hourly rate: £50.
  • Out-of-scope work quoted and agreed in advance.

6. Whitelabel Agreement & Confidentiality

  • The Service Provider acts as an extension of the Agency’s team.
  • All Agency IP, contacts, and data remain confidential.
  • No direct solicitation of Agency clients.
  • Mutual trust and IP protection are expected.

7. Quoting & Deliverables

For The Service Provider to give an accurate quote per project, we will require the information below.

  • Clear brief and sitemap.
  • PDF design to scale.
  • Clear outline of all dynamic functionality. If not included in the brief or unclear, it will be considered out of scope.
  • Clear timeline and expectations

8. Service Provider Requirements

  • Clear brief and sitemap.
  • PDF design to scale.
  • Fonts (WOFF2 & TTF), SVGs for icons/logos.
  • Designs in XD, Sketch, or Figma in pixels and to scale
  • Brand sheet with typography, spacing, and colours (where available).
  • The Agency must supply all content and images.
  • Late content updates post-dev completion are out of scope.

9. Revisions & Amendments

  • Two rounds of revisions for bugs, CSS and responsive tweaks.
  • New features not outlined in the brief or design are out of scope.
  • Websites are easy to update post-handover by the Agency or client.

10. Data Protection & Force Majeure

  • Both parties will comply with UK GDPR and the Data Protection Act 2018.
  • Neither party shall be liable for delays resulting from unforeseen events (e.g., war, pandemics).

11. Limitation of Liability

  • The Service Provider is not responsible for malware, breaches, data loss or server issues unless otherwise agreed.
